Godbless Lema Try Again his luck Leo court after inmates languishing for 19 days
Another attempt to guarantee the application of the Arusha Urban MP (Chadema) Godbless Lema held today after languishing in custody since his arrest in Dodoma Nov. 3.
Lema, who is facing charges of giving inflammatory language against President John Magufuli, that request becomes the third bond after crash twice since he was brought in custody.
Lema, who is represented by six lawyers; Peter Kibatala, John Mallya, Charles Adiel, Adam Jabir, Comfort Mangula and Misheck Mfinanga, despite his bail granted by the Magistrate, Desdery Kamugisha aroused due to the notice of appeal submitted by government lawyers.
After such notice, Lema wrote letters requesting the Supreme Court to review the case notes that legal procedures violated due to the judge to give bail, but failed to complete the terms of the bond and receive the arguments of the Republic.
However, a senior government lawyer, Paul Kadushi presented another objection against the Supreme Court to return the case.
Kadushi presented two issues binding upon oppose the request of the member that the applicant did not meet the criteria to apply to the court's return court decisions in that instead of writing for the court a letter requesting to make a review of that decision, he would have to cut an appeal on the court decision.
Also, he said such requests yamekinzana and Magistrates Courts Act, subsection (43) (2) due to the court's inability to receive a request or appeal these decisions, since they are smaller.
However, advocates of Lema objected to these arguments and explain the rules allow the complainant to write a letter asking for a review, and already it has ever done to the attorney general's office and requesting a review.
Kibatala lawyer said the Supreme Court has jurisdiction to review the case itself even if no one had ever complained and ready to review several cases.
After the arguments of both sides delivered judge Sekela Moshi pleaded given time, through all the arguments brought by both sides to exercise decisive today.
